These Terms of Service apply to services provided by Concept Design Colour Finish Pty Ltd.
Specific project services, scope, fees, payment terms, deliverables and timelines will be set out in the proposal, fee agreement or other written agreement provided for each project. If there is any inconsistency between these Terms and a signed project agreement, the project agreement will apply to the extent of that inconsistency.
Services
Concept Design Colour Finish provides interior design and related services, which may include spatial planning, interior detailing, colour and material selection, specifications, furniture selection, custom joinery, styling and other agreed design services.
We will confirm the precise scope of each engagement in writing before work commences.
Client responsibilities
Clients are responsible for providing accurate and timely information relevant to the project, including project requirements, budgets, approvals and other information reasonably required for us to perform our services.
Unless expressly included within our agreed scope, clients remain responsible for obtaining necessary permits, approvals and professional advice required for construction or implementation.
Fees and payment
Fees, payment schedules and any reimbursable project expenses will be specified in the relevant proposal or project agreement.
Additional work outside the agreed scope may be charged separately with the client's approval.
We may suspend work where an invoice remains overdue in accordance with the applicable project agreement.
Intellectual property
Unless otherwise agreed in writing, Concept Design Colour Finish retains copyright and other intellectual property rights in design concepts, drawings, specifications and documentation created by us.
Once all amounts relating to the relevant work have been paid, the client may use the final design documentation for the project and property for which it was prepared.
Design documentation must not be reproduced, adapted or used for another property or project without our written consent.
Third-party products and services
We may recommend or coordinate with builders, consultants, suppliers, trades or other third parties.
Unless expressly stated otherwise in writing, those third parties provide their goods or services independently and remain responsible for their own work, products, warranties and obligations.
Variations and implementation
Changes to the agreed brief, scope or design may affect fees, procurement requirements and project timelines.
Actual materials, finishes and products may vary from samples, digital images or visual representations due to natural variation, manufacturing processes, availability and other factors outside our reasonable control.
Consumer rights
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where our services are subject to statutory consumer guarantees, those guarantees continue to apply.
Liability
To the extent permitted by law, Concept Design Colour Finish is not responsible for loss or damage caused by matters outside our reasonable control, including the acts or omissions of independent builders, contractors, consultants, suppliers or manufacturers.
Any limitation of liability in these Terms applies only to the extent permitted by applicable law.
Termination
Either party may terminate an engagement in accordance with the relevant proposal or project agreement.
On termination, the client remains responsible for fees for services already performed and approved expenses incurred up to the effective termination date.
Confidentiality
We will take reasonable steps to protect confidential information provided to us in connection with a project.
Clients must similarly respect confidential or proprietary information belonging to Concept Design Colour Finish.
Governing law
These Terms are governed by the laws of Victoria, Australia.
